1. About these terms
These terms govern your use of the website fluent14.com and the Fluent14 app (together, the “Service”), provided by phpdev.in, India (“Fluent14”, “we”, “us”). By using the Service — or by creating an account — you agree to these terms and acknowledge our Privacy policy. If you don't agree, please don't use the Service.
These terms are an electronic record under the Information Technology Act, 2000 and the rules made under it, and do not require a physical or digital signature. Where we act as an intermediary for content you upload, we follow the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 to the extent they apply.
2. Development status
Fluent14 is under development. Until launch, only this website is available. Early or beta versions of the app may be incomplete, change often, or contain errors, and features described on this website may change before or after launch.
3. Eligibility
Fluent14 has no minimum age — anyone can learn English with it. If you are under 18, you may use Fluent14 only with the consent of your parent or lawful guardian, which we verify as described in our Privacy policy. Because a minor cannot enter a binding contract under the Indian Contract Act, 1872, the parent or guardian accepts these terms on the learner's behalf, is responsible for the learner's use of the Service, and should supervise younger learners. You must not use the Service if you are barred from doing so under any applicable law.
4. Your account
- Give accurate information and keep it up to date.
- Keep access to your Google account, email or Telegram account secure — whoever controls it can sign in to Fluent14.
- One account per person. Don't share, sell or transfer your account.
- Tell us promptly at security@phpdev.in if you think someone else has accessed your account.
5. Acceptable use
You agree not to use the Service to host, display, upload, share or transmit anything that:
- belongs to someone else and you have no right to;
- is obscene, pornographic, paedophilic, invasive of another's privacy (including bodily privacy), insulting or harassing on the basis of gender, racially or ethnically objectionable, promotes money laundering or gambling, or encourages violence;
- is harmful to children;
- infringes any patent, trademark, copyright or other proprietary right;
- deceives or misleads about where a message came from, or knowingly spreads false or misleading information;
- impersonates another person;
- threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order, or incites any offence;
- contains viruses or any code designed to interrupt, destroy or limit any computer resource; or
- violates any law in force in India.
You also agree not to: access the Service by automated means (bots, scrapers) without our written permission; reverse-engineer, copy or resell the Service or its content; try to bypass security, rate limits or usage limits; record other people without their consent; or use the Service in a way that harms other learners or our systems.
6. Your content and recordings
Your answers, recordings and other content you create (“Your Content”) remain yours. You give us a limited, non-exclusive, royalty-free licence to store, process and display Your Content only to provide the Service to you — for example, to check answers, run your mistake bank and build your report. This licence ends when you delete Your Content or your account, except for copies we must keep by law. We do not use your recordings to train third-party AI models.
If you choose to share your report or recordings outside the app, you are responsible for what you share and with whom.
7. Learning outcomes and AI feedback
Fluent14 is a practice tool for general English improvement. It is not a certified course, qualification or official test, and it does not issue certificates recognised by any authority.
- No guaranteed results. The 14-day program is designed to help you make fewer mistakes and speak with less hesitation, but outcomes depend on your starting level, effort and practice. We do not guarantee fluency, a job, admission, a visa or any test score.
- Automated feedback may be wrong. Speech recognition and answer checking are automated and can make mistakes, especially with background noise or accents. Use your judgement, and report errors to us.
- Illustrations. Examples and sample reports on our website are illustrations, not results from real users, unless clearly stated.
8. Price and paid features
Fluent14 will be free at launch. If we introduce paid plans, programs or in-app advertising later, we will:
- show the total price in Indian Rupees, including taxes, and what you get, before you pay;
- publish clear refund and cancellation terms, and provide a simple way to cancel;
- never charge you without your explicit action, and never enrol you in a paid plan by default;
- follow the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020 and the Guidelines for Prevention and Regulation of Dark Patterns, 2023; and
- update these terms and our privacy policy first.
Features that are free when you use them won't be taken away retroactively from content you've already created — your recordings and data will always remain exportable.
9. Our intellectual property
The Service — including its design, software, lessons, sentences, audio, text, graphics, the Fluent14 name and logo — is owned by phpdev.in or our licensors and protected by law. We grant you a personal, non-transferable, revocable licence to use the Service for your own learning. You may not copy, distribute, sell or create derivative works from our content without written permission.
If you send us suggestions or feedback, we may use them freely to improve the Service, without obligation to you.
10. Third-party services
Signing in with Google or Telegram, and receiving push notifications, involves third-party services that have their own terms and privacy policies. We are not responsible for those services.
11. Availability and changes to the Service
We work to keep the Service available, but it may be interrupted for maintenance, updates or reasons beyond our control. We may change, add or remove features. If we discontinue the Service, we will give you reasonable notice and a way to export your data.
12. Ending your use
You can stop using the Service and delete your account at any time from the app or by contacting us. We may suspend or close an account that seriously or repeatedly breaks these terms or the law, or to protect other users or the Service. Except where the law or safety requires otherwise, we will tell you why and give you a chance to respond, and you can still request your data.
13. Disclaimers
To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind beyond those that cannot be excluded under Indian law. See also our Disclaimer.
14. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, or for loss of opportunity (such as a missed job, admission or test result), arising from your use of the Service. Since the Service is free, our total liability for any claim relating to the Service is limited to ₹1,000, or, if you have paid us, the amount you paid in the 12 months before the claim, whichever is higher. Nothing in these terms limits liability that cannot be limited by law, including for fraud or under the Consumer Protection Act, 2019.
15. Indemnity
If you misuse the Service or break these terms or the law, and that causes a claim against us by someone else, you agree to cover our reasonable costs of that claim, to the extent permitted by law.
16. Governing law and disputes
These terms are governed by the laws of India. Please contact us first — most problems can be solved quickly by email. Subject to your rights as a consumer to approach a Consumer Commission where you live, the courts having jurisdiction over our principal place of business in India will have exclusive jurisdiction.
17. Grievances and contact
Contact our Grievance Officer at grievance@phpdev.in. We acknowledge complaints within 24 hours on working days and resolve them within the time limits set by law (we aim for 15 days). Requests to remove unlawful content are handled within the timelines required by the IT Rules, 2021. General support: hello@fluent14.com.
18. General
If any part of these terms is found unenforceable, the rest stays in effect. If we don't enforce a right immediately, we haven't waived it. You may not transfer these terms; we may transfer them to a successor of the Service with notice to you. We may update these terms; for significant changes we will notify app users in advance, and continued use after the effective date means you accept the updated terms.
